The general conditions of sale are concluded between the person making a purchase on the online sales site www.triloop.fr and SAS Triloop.

The buyer acknowledges having read these General Conditions of Sale and accepts them. The validation of the order by the customer entails the unreserved acceptance of these General Conditions of Sale.

1 - IDENTITY

The Triloop brand is a brand registered with the INPI and operated by the company SAS Triloop, SAS with a capital of €6,000 whose contact details and legal information are as follows:

2 - PURPOSE

These general conditions of sale (hereinafter the "GTC") govern the terms and conditions of sale of all the products presented by the company SAS Triloop (hereinafter "Triloop"), on its website www. triloop.fr (hereinafter the "Site"), to any adult person, having the quality of consumer, within the meaning of the introductory article of the Consumer Code, as well as the capacity (hereinafter the "Buyer" ).

Triloop reserves the right to modify the T&Cs at any time. The modifications are binding on the Buyers from the time they are put online and cannot be applied to transactions concluded previously. A copy of the GCS applicable on the date of the order is available on request from the Buyer.

3 - THE PRODUCTS

3.1 Product characteristics

The characteristics of the products you order are indicated on the pages of the site www.triloop.fr. Triloop undertakes to present the products as faithfully as possible.

All the products offered comply with French legislation.

Only the information on the product sheet has proof value between Triloop and the buyer. This information can be modified or deleted by the Triloop seller.

3.2 Product Availability 

The Triloop seller undertakes to ship all the products ordered and paid for by the buyer within the limits of available stocks.

If a product should be out of stock after the purchaser's order has been finalized, Triloop will inform the customer by email or telephone and undertakes to offer him the choice of:

- A refund equivalent to the value of the product out of order

- A credit note equivalent to the value of the out-of-stock product, credited to the customer's account

- An exchange

As part of a refund request, Triloop undertakes to reimburse the customer within a maximum of 10 working days from the date of the customer's request. The refund will be made directly to the bank account used for payment of the order.

4 - PRICES

4.1- General

For deliveries of Triloop products made on the metropolitan territory of the European Union, the prices indicated are expressed All Taxes Included and do not include any preparation and delivery costs.

For deliveries outside the metropolitan territory of the European Union, the prices are expressed excluding any taxes. The Customer undertakes to pay, where applicable, all taxes that may be required of him by the Country of delivery, and in particular value added tax and any customs duties. These rights may be requested by the carrier. Triloop cannot be held liable in the event that the Customer has not paid these taxes and duties. In the event of the Customer's refusal, Triloop reserves the right to invoice the Customer for the shipping and return costs of the package and a flat-rate order preparation cost (variable depending on the order: €5 to €20). In case of refusal of personalized products in the name of the Customer, the refund cannot be made.

The valid price is the one displayed on the product sheet on the date of purchase.

Delivery costs may be invoiced with your order depending on its total amount and the country of delivery of the order.

The amount (price of the products and delivery costs) indicated in the order confirmation by Triloop is the total price payable by the Customer.

SAS Triloop reserves the right to modify its prices at any time.

The total price of the paid order includes:

- The total price of the products purchased with any discounts deducted.

- Order preparation costs.

- The shipping costs of the order.

4.2 Price changes

As part of commercial operations, flash sales or promotions, the prices displayed may decrease temporarily over a period of time indicated on the site.

These possible price reductions cannot be the subject of a refund request from the buyer if he had paid for the product(s) at the higher price outside the promotion period. Conversely, Triloop is required to respect the prices displayed on the day of validation of the order, including in the event of an increase.

 4.3 Price display error

The prices displayed are subject to visible errors. In the event of an obvious error in the display of prices, Triloop undertakes to contact the customer to warn him and to offer him to pay the difference in price or to cancel his order if he wishes.

5. ORDER PROCESS

In order to validate his order, the buyer must follow several steps:

- He selects the products he wishes to buy on the www.triloop.fr site from the offer available on the site.

- He must identify himself (account already created) or create a customer account on the site by filling in the necessary information (surname, first name, physical address, telephone number, email).

- The buyer validates the information relating to his order (products, price, address).

- The buyer chooses the type of delivery and the method of payment he wishes.

- The buyer accepts these T&Cs (check box).

- The buyer validates his order via a secure payment module (SSL).

This last step constitutes the irrevocable acceptance of the sales contract.

A summary of his order is sent to him via an order confirmation email.

We reserve the right to refuse any order from a customer with whom there is a dispute.

6 - DELIVERY

6.1 General

Except in exceptional cases, all the products of an order will be delivered at once. The products will be delivered to the delivery address that the customer will have indicated at the time of the validation of his order.

For orders including one or more products unavailable at the time of shipment, Triloop reserves the right to ship the order without the unavailable products. In this case, the buyer will be reimbursed or credited with a credit note equivalent to the amounts of the unavailable products. within 10 working days.

Upon receipt of the products, the customer must check the condition of the products he has purchased.

6.2 Delivery method and rates

Several types of delivery are possible depending on the customer's choice.

Delivery prices vary depending on the type and country of delivery.

Delivery methods and prices are detailed in the “delivery policy” section.

6.3 Delivery times

The products are shipped with the delivery note corresponding to the order, to the delivery address indicated by the Customer when ordering. Delivery cannot be made to hotels or PO boxes.

The delivery times indicated on the site are indicative times, corresponding to the average processing and delivery times. In order for these deadlines to be respected, the Customer must ensure that he has communicated exact and complete information concerning the delivery address (such as street number, building number, staircase number, access codes, names and /or intercom numbers, etc.).

The items are delivered within 1 to 15 working days from the order throughout Metropolitan France. This deadline is given as an indication and may vary depending on the availability of the items.

Exceeding this period can in no way be held against Triloop, nor give rise to a termination of the contract or any compensation for damages.

Beyond a period of one month from the date of the order, Triloop will refund the undelivered goods by bank transfer.

Triloop undertakes to inform the Customer of the progress of the processing of his order.

Packages are delivered by Mondial Relay, La Poste or by a carrier to the address indicated when ordering. As such, Triloop is not able to guarantee a precise time of delivery.

Triloop cannot be held liable in the event of contractual non-performance resulting from a case of force majeure, in particular, and without limitation, in the event of war, riot, insurrection, interruption of transport, imports, strikes, shortages, fires, earthquakes, storms, floods.

6.4 Returns

Products can only be returned within the framework of the right of withdrawal. The customer has 14 working days from the date of receipt of his order, to make his return request by contacting Customer Service. He then has 30 days to return the products.

For any return request, it is mandatory to contact Triloop Customer Service before returning any products. If this was not done, the return request could not be processed upon receipt.

To make a return, it is necessary to validate the terms of the return with Customer Service.

An item returned within 30 days of the date of receipt of the order may be refunded or benefit from a credit note according to the customer's choice.

An item returned beyond 30 days following the date of receipt of the order can only benefit from a credit note.

The return costs are the responsibility of the customer, Triloop bears the return costs in the event of an exchange.

Returned products can only be tried-on products (not worn in training or washed). The gifts offered with the products must also be returned (present on the invoices, and the order history).

7. RIGHT OF WITHDRAWAL

As part of the right of withdrawal, the customer has 14 working days from the date of receipt of his order, to make his return request by contacting Customer Service. He then has 30 days to return the products. Returned products must be in perfect condition, unworn and in their original packaging. In accordance with the provisions of article L 121-20-2 of the Consumer Code, the right of withdrawal cannot be exercised for personalized and perishable products.

 

ATTENTION, no right of withdrawal is possible on personalized and perishable products.

8. DISPUTES

In accordance with the provisions of the Consumer Code concerning the amicable settlement of disputes, JCR adheres to the Service of the Mediator.

After prior written action by consumers vis-à-vis JCR, the Mediator's Service may be contacted for any consumer dispute whose settlement has not been successful.

9. PAYMENT

Full payment must be made when ordering. At no time can the sums paid be considered as a deposit or installment. The Customer pays for his order by Credit Card (Visa, Eurocard/Mastercard) and/or PayPal in accordance with the provisions of this article.

For any transaction by credit card, the Customer will indicate the number appearing on the front of his card, the expiry date of his card and the cryptogram appearing on the back of his card (last three digits).

The communication by the Customer of his credit card number constitutes authorization for TRILOOP to debit his account for the amount of his order.

No shipment against reimbursement will be accepted, whatever the reason.

Triloop retains ownership of the item until full payment of the price by the Customer. Purchases are made securely. For payments by credit card (credit card, visa credit card and e-credit card), PayPal is responsible for securing payments. All information that Customers communicate to Triloop is strictly protected and guarantees the compliance and security of each transaction.

10. CREDIT AND REFUNDS

For all defective products or for a product delivery error on our part, a credit note or a refund of all sums received (product + postage + return postage, based on La Poste's rates) will be offered to the customer.

11. PERSONAL DATA

The data collected on the site is for purely internal use and allows us to process orders. SAS Triloop refuses any disclosure of this information. You agree to give your consent to such use of personal data. In application of the Data Protection Act of 06/01/1978, the customer has the right to access, rectify and oppose the data recorded concerning him. This right of rectification may be exercised at any time by mail sent to our address.

12. APPLICABLE LAW

This contract is subject to French law, the language of the contract is French. Any dispute arising in connection with the application or interpretation of this contract will be submitted to the French courts, which have sole jurisdiction.
